1. AGREEMENT TO TERMS
By accessing or purchasing from OMGITSHAIR ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use our store.
2. PRODUCTS AND PRICING
All product descriptions, images, and specifications are provided as accurately as possible. However, we do not warrant that product descriptions, colors, or other content are accurate, complete, or error-free. Wigs and hair products may vary slightly in color, texture, and appearance from images due to lighting, screen settings, and the natural variation in human hair and synthetic materials.
All prices are in USD and subject to change without notice. We reserve the right to correct pricing errors and cancel orders placed at incorrect prices.
3. ORDER ACCEPTANCE
We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, errors in pricing or product information, suspected fraudulent or unauthorized transactions, or violation of these Terms. If your order is cancelled after payment, we will issue a full refund.
4. PAYMENT
Payment is due at the time of purchase. By providing payment information, you represent that you are authorized to use the payment method. We use Shopify Payments and other secure payment processors. We are not responsible for declined transactions, bank fees, or payment processing issues beyond our control.
5. REFUNDS AND RETURNS
ALL SALES ARE FINAL. Due to hygiene regulations and the personal nature of wigs and hair products, we do not accept returns, exchanges, or offer refunds except as required by law. Please review our separate Refund Policy for complete details.
Defective products may be eligible for replacement within 7 days of delivery with photographic proof of the defect. Contact us at vtgonedoit@gmail.com immediately if you receive a defective item.
6. SHIPPING AND DELIVERY
We are not responsible for delays caused by shipping carriers, customs, weather, or other events beyond our control. Delivery timeframes are estimates only. You are responsible for providing accurate shipping information. We are not liable for packages delivered to incorrect addresses provided by you.
7. CHARGEBACKS AND DISPUTES
You must contact us at vtgonedoit@gmail.com before filing any chargeback or payment dispute. Filing a chargeback for a valid order constitutes fraud and may result in:
- Immediate account termination
- Reporting to fraud prevention agencies
- Collection efforts for the full order amount plus chargeback fees
- Legal action
Chargebacks filed without first attempting to resolve the issue with us will be contested with full documentation.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, OMGITSHAIR shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or website. Our total liability for any claim related to our products or services is limited to the amount you paid for the specific product in question.
We do not guarantee that our products will meet your specific expectations or achieve particular results. Wigs and hair products require proper care and maintenance, which is your responsibility.
9. USER CONDUCT
You agree not to:
- Use stolen or unauthorized payment methods
- Provide false or fraudulent information
- Attempt to abuse our policies or exploit pricing errors
- File false chargebacks or payment disputes
- Engage in any illegal or unauthorized use of our store
Violation of these terms may result in account termination and legal action.
10. INTELLECTUAL PROPERTY
All content on our website, including images, descriptions, logos, and designs, are owned by OMGITSHAIR or our licensors and protected by copyright and trademark laws. You may not use our content without written permission.
11. DISPUTE RESOLUTION
These Terms are governed by the laws of the United States and the State of Michigan, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our store shall be resolved in the courts of Michigan.
You agree to first attempt to resolve any dispute by contacting us at vtgonedoit@gmail.com. If we cannot resolve the dispute within 30 days, either party may pursue formal legal action.
12. MODIFICATIONS
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our store after changes constitutes acceptance of the modified Terms.
13. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
